Village of New Lenox Approves Massive Age-Restricted Subdivision

The Village of New Lenox has approved a 612-unit, single-family residential development called “Four Seasons of New Lenox.” The development will be located north of Route 6 and east of I-355, near Silver Cross Hospital, and will meet the criteria for Housing for Older Persons under the United States Fair Housing Act (allowing for the imposition of age-based residency criteria).

Partner Chris Spesia represented the Village and worked with the developer in drafting an Annexation Agreement and a PUD Ordinance that will control the development of the 200+ acre project. According to Spesia, “The project posed a number of challenges including the Village’s desire to ensure that the age-restriction covenant is valid and binding and the various construction-related issues that inevitably arise when dealing with a development of this character, size, and scope.

The PUD and annexation processes have allowed the Village great flexibility to address its impact fees and zoning, building, and subdivision codes, all the while ensuring that the end product will be of the character and quality that New Lenox demands from other home builders. The PUD also grants the Village great latitude in the location of the proposed 15,000 square foot Clubhouse and attendant Amenity Center, which will feature various recreational improvements. The project should provide a catalyst for the continued development of the area surrounding Silver Cross and the I-355 Interchange.”
