Dental Malpractice Case Settles For $250,000.00

In 2009 and 2010, a dentist extracted eight teeth and inserted corresponding implants into the maxilla (upper jaw) of a 66 year old patient. However, due to the dentist’s negligence the implants failed, resulting in serious bone loss across his patient’s maxilla. In addition, the dentist had negligently drilled two of the implants directly into the patient’s nasopalatine nerve and maxillary sinus, which caused her significant and continuous pain.

Spesia & Taylor fought to hold the dentist accountable for his negligence, and won a favorable decision in the appellate court. In the appellate court, attorneys John Spesia and Jacob Gancarczyk successfully advocated on behalf of the patient to prevent the dentist from using improper evidence at trial. The appellate court agreed and barred the dentist from admitting prejudicial evidence. 2017 IL App (3d) 140926.

After securing the favorable decision in the appellate court, Attorneys John Spesia and Jacob Gancarczyk secured a $250,000 settlement. The patient said she was “very satisfied” and “very happy that we won the case” and thankful for “John and his firm for turning the negative experience with [her] dentist into a positive outcome.”
